Terms of Service

These Terms of Service ("Terms") govern your use of the Speech Arcade platform operated by JGSLP LLC ("Speech Arcade," "we," "us," or "our"). By accessing or using Speech Arcade at speecharcade.com and app.speecharcade.com, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account or using Speech Arcade, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the service on behalf of a school, district, or organization, you represent that you have the authority to bind that entity to these Terms.

Description of Service

Speech Arcade is a web-based platform that provides interactive games and tools for speech-language pathologists (SLPs) and educators to deliver engaging speech therapy sessions. The platform includes game-based practice activities, custom question list creation, student management, session launching, and automatic data tracking.

We reserve the right to modify, update, or discontinue features of the platform at any time. We will provide reasonable notice of significant changes that affect your use of the service.

User Accounts

To use Speech Arcade, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that student information you enter is accurate and appropriately de-identified
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used in an unauthorized manner.

Subscription and Billing

Speech Arcade offers subscription plans on a monthly or annual basis. By subscribing, you agree to the following:

• Free trial: New accounts receive a 7-day free trial. No credit card is required to start your trial. If you do not subscribe before the trial ends, your access to paid features will be restricted
• Billing cycle: Subscriptions are billed at the beginning of each billing period (monthly or annually). Payments are processed securely through Stripe
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date
• Refunds: We do not provide prorated refunds for partial billing periods. If you believe a charge was made in error, please contact us at support@speecharcade.com
• Price changes: We may adjust subscription prices with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect on their account

Acceptable Use

You agree to use Speech Arcade only for its intended purpose -- delivering speech and language therapy through interactive games and tools. You may not:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the platform
• Use automated scripts, bots, or scrapers to access the service
• Upload malicious content, viruses, or harmful code
• Share your account credentials with others or allow multiple individuals to use a single account
• Resell or redistribute access to the service without our written consent

Intellectual Property

All content, designs, code, games, graphics, and materials on the Speech Arcade platform are owned by JGSLP LLC and are protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our materials without prior written permission.

Question lists and student data you create remain your property. You grant us a limited license to store and process this data solely for the purpose of providing the Speech Arcade service to you.

Limitation of Liability

To the maximum extent permitted by law, JGSLP LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

Our total liability for any claims arising from your use of Speech Arcade is limited to the amount you paid us in the 12 months preceding the claim. The service is provided "as is" and "as available" without warranties of any kind, either express or implied.

Speech Arcade is a supplementary therapy tool and is not a substitute for professional clinical judgment. SLPs remain responsible for all clinical decisions regarding student care.

Termination

We may suspend or terminate your access to Speech Arcade at our discretion if you violate these Terms or engage in conduct that we determine to be harmful to the service or other users. Upon termination:

• Your right to access the platform ceases immediately
• You may request export of your data for up to 30 days after termination
• We will delete your account data in accordance with our data retention policies

You may terminate your account at any time by canceling your subscription and contacting us at support@speecharcade.com.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending an email to your registered address at least 30 days before changes take effect. Your continued use of Speech Arcade after the updated Terms become effective constitutes your acceptance of the changes.
